The developers of Samourai Wallet have just filed a motion to dismiss criminal charges from the U.S. Department of Justice (DOJ), arguing that the application is open-source software that does not hold users' assets and should not be regarded as a financial institution.

The petition cites guidance from FinCEN stating that anonymizing software is not subject to money transmission licensing. The lawyer argues that if the lawsuit continues, it could criminalize the development of privacy-protecting software and threaten civil liberties.
