Republican representative William Timmons has requested that SEC Chairman (SEC) Paul Atkins provide documents on how the SEC handled Ether under Gary Gensler. In the letter, Timmons emphasized that understanding the SEC's historical perspective on Ether will help the public and Congress gain a clearer understanding of how previous leaders approached this issue.

He pointed out that in 2018, the SEC declared Bitcoin and ETH not securities, but Gensler cast doubt on the status of ETH by refusing to answer questions about this during a hearing in April 2023. Timmons also mentioned that the SEC approved the Ether-traded fund a year later, causing confusion for many crypto market participants.
