Precedent Decision on Cryptocurrencies from KVKK!
As in the rest of the world, **Bitcoin (BTC) and **cryptocurrencies continue to be popular in our country.
At this point, while the legal regulation studies on cryptocurrencies continue, a new decision has come from the Personal Data Protection Authority (KVKK) regarding cryptocurrencies.
According to Habertürk's report, the KVKK has decided that the processing of identity and photo information of the members of cryptocurrency platforms is within the scope of its obligations under the Law on the Prevention of Laundering Proceeds of Crime.***
This decision of the KVKK is based on a complaint made by a person that he asked for his identity information while subscribing to the cryptocurrency platform.
According to the incident, the complainant requested an increase in the membership level of a cryptocurrency platform he is a member of. This cryptocurrency platform, on the other hand, asked for a photo of the front and back of the person's ID and a passport photo.
At this point, the person, who argued that personal data was requested by the crypto platform more than necessary and excessively, applied to the KVKK with the request to conduct an examination within the scope of the Personal Data Protection Law No. 6698 and to delete the processed information.
KVKK made a precedent decision and pointed out that the cryptocurrency platform has an obligation under the Law No. 5549 on the Prevention of Laundering Proceeds of Crime regarding the processing of personal data, and decided that data request and processing is legal.
The Board stated that the request for the deletion of the applicant's personal data should first be submitted to the crypto platform, which is the data controller, and decided that there was no action to be taken.
